Terms of Use
Last updated: 3 November 2026
In short
Boat Boffin helps a syndicate organise its boat. You own your records. We do our best to keep the app running, but it’s a helper, not a replacement for good judgement, professional advice or safe seamanship.
1. About these terms
These terms are an agreement between you and Litoria Solutions (“we”, “us”) about the Boat Boffin app (app.boatboffin.com) and website (boatboffin.com). By signing in or using the app you agree to them. If you don’t agree, please don’t use the app. If you use it for a syndicate, you confirm you have the authority to do so. Our Privacy Policy explains how we handle your information.
2. Accounts and syndicates
- You sign in with a Google account. Keep it secure. You’re responsible for what happens under your sign-in.
- A syndicate’s admin sets the syndicate up, adds and removes partners, chooses the rules and permissions, and manages the plan and payment.
- Admins are responsible for adding only people who should have access, and for having their agreement to be added.
- You must give accurate information and use the app lawfully.
- You must be at least 16 years old, and have the right and authority to agree to these terms (for a syndicate, on its behalf).
3. Plans and payment
- The Free plan costs nothing. Paid plans (such as Crew and Boffin) are charged per boat, through Stripe, at the prices shown on boatboffin.com when you sign up. Prices include GST or VAT where it applies, except in US$.
- Paid plans renew automatically each billing period until cancelled. You can cancel or change plan from the app. Cancelling takes effect at the end of the period already paid for.
- When you upgrade, we charge the difference for the rest of the current period straight away.
- Fees already paid are generally not refundable, except where the law (including the Australian Consumer Law) says otherwise or we agree in writing.
- If a payment fails, we’ll email the admin and the payment may be tried again. If it still can’t be taken, the boat moves to the Free plan. Please keep your billing details up to date in Stripe.
- We may change prices or features with at least 30 days’ notice. We’ll tell you the new amount and the date it starts before you’re charged it. The change applies from your next renewal, and you can cancel before then.
4. Your records
Your syndicate’s information, photos and documents stay yours. You give us permission to store, process and display them only so we can run the app for you, including by sending them to the services listed in the Privacy Policy. You can ask us for a copy at any time by emailing hello@boatboffin.com. You’re responsible for having the right to upload what you add, and for keeping your own copy of anything important.
5. Boffin, the AI helper
Boffin uses artificial intelligence. It can make mistakes, misread a receipt or manual, or give out-of-date answers. Please check anything that matters before you act on it. Boffin’s answers are general information only. They are not legal, financial, tax, insurance, engineering or safety advice. For anything like that, talk to a qualified professional.
6. Safety and information from the app
The app can show weather, tides, marine warnings, maintenance reminders and checklists. These help you stay organised and are not a substitute for your own judgement. Weather and tide information comes from third parties and may be wrong or late. You’re responsible for the safe operation, seaworthiness, insurance, registration and maintenance of your boat, for checking official forecasts and warnings, and for following the rules of the waters you use. The app’s bookings and rules are the syndicate’s own arrangements. We don’t take part in disputes between partners.
The app and website link to, and use information from, other services such as the Bureau of Meteorology and Stripe. We don’t control them, and they may have their own terms and privacy policies.
7. Acceptable use
Please don’t:
- break the law or use the app to harass, deceive or harm anyone;
- upload anything harmful, such as malware, or anything you don’t have the right to share;
- try to get into another syndicate’s records, probe or attack the app, or overload it;
- copy, resell or reverse-engineer the app, except as the law allows;
- scrape or automatically collect information, such as partner lists, or show the app inside another website or app.
We may suspend or close an account that breaks these terms or puts others at risk. Where we can, we’ll tell you first. We may also remove uploaded content that breaks these terms or the law.
If you believe something in the app infringes your copyright, email hello@boatboffin.com with what it is, where it is and why you believe it’s yours, and we’ll look into it promptly.
8. Our rights in the app
We own the app, the Boat Boffin name, the octopus and our designs. These terms don’t give you ownership of them. You may use the app for your syndicate while you’re entitled to. If you send us feedback or ideas, we may use them without owing you anything.
9. Availability
We work to keep the app running, but we can’t promise it will always be available or error-free. Parts of the app work offline, and changes made offline are sent when you’re back in range, so please check that important changes have gone through. We may change or retire features. If we remove something you’ve paid for, we’ll refund the unused part.
10. Our responsibility
Our services come with guarantees under the Australian Consumer Law that can’t be excluded. Subject to those, and to the extent the law allows:
- the app is provided “as is”, and we don’t promise it will meet every need;
- we are not liable for indirect or consequential loss, such as lost bookings, lost use of a boat or lost profits, or loss from relying on Boffin, weather or other information shown in the app; and
- our total liability to you for any claim about the app is limited to the amount you paid us in the 12 months before the claim.
Where the Consumer Law lets us limit a remedy, we limit it to supplying the service again or paying the cost of having it supplied again. Nothing in these terms limits any rights you have under the law that can’t be excluded.
You agree to be responsible for the content you upload and your use of the app, and to cover us for claims by others that arise from your breaking these terms or the law.
11. Ending
You can stop using the app at any time. An admin can delete a boat from the app. We may end or suspend access as set out in these terms. After that, we’ll handle your records as the Privacy Policy describes. Sections that by their nature should continue (such as 4, 10 and 12) will.
12. General
- Changes: we may update these terms. We’ll change the date above and tell admins by email about changes that matter. If you keep using the app after a change takes effect, you accept it.
- Law: these terms are governed by the law of New South Wales, Australia, and both of us submit to the courts of New South Wales. This doesn’t limit any rights you have under mandatory consumer law where you live.
- Relationship: these terms don’t make you and us partners, employer and employee, or agent and principal. We may transfer our rights and duties under them if we sell or restructure the business. You can’t transfer yours without our agreement.
- Legal requests: we may follow the law, court orders and requests from authorities, including by disclosing information as the Privacy Policy describes.
- The whole agreement: these terms and the Privacy Policy are our full agreement. If part of them isn’t enforceable, the rest still applies.
